*The following material cites some cases and codes that apply only to the State of Texas.
I believe with all of my heart and sound mind that I have a God given right to not only possess, but should be free to allow the growth of the tax free plant, cannabis sativa, as evident in the Holy Bible. My objection to the statute of Health and Safety Code, Sec. 481.121 (b) (3)*, that attempts to make the possession of marijuana a crime and for certain sizes or quantities of Marijuana it is considered a controlled substance, is as follows:
The question is: Who controls cannabis?
Answer: God made all things as rooted in the Scripture in Genesis, and specifically God made plants in Genesis 1:11 on the third day, “That the trees produce fruit with seed in it of its own kind” and in Genesis 11:12“God saw that it was good.”
Genesis 1:11Genesis 1:12
In Genesis 1:29, God says again that the fruit from trees is for man’s consumption, and that it was all a gift from him.
Genesis 1:29
Also, in 1 Corinthians 10:26 Paul writes to the church of Corinth that “you can eat it, because the earth and everything in it belong to the Lord.” This statement comes directly from Psalms 24:1; 50:12; and 89:11, which concurs with that which is written in Genesis.
Allowing what God made in the beginning to be free and lawful would honor Him and to allow every man and woman the right to their free exercise of religion, which is guaranteed by the First Amendment to the Constitution of the United States of America, the most protected of Constitutional Rights.
“The protection of the free exercise clause extends to all sincere religious beliefs; courts may not evaluate religious truth,” – United States v. Lee, 445 U.S. 252, 257, 102 S.Ct. 1051, 1055, 71 L.Ed. 2d 127 (1982); AND UNITED STATES V. BALLARD, 322 U.S. 78, 86-87, 64, S. Ct. 882, 886-887, 88 L. Ed. 1148 (1944)
With these things considered I pray that any court wishing to impose their jurisdiction upon my beliefs do consider the above rulings and cited cases in which my beliefs outweigh the Government’s ability to impose their opinions and efforts to criminalize my religious actions.
